Title Application and Power of Attorney

When you purchase a vehicle, take a trade in, or sell a vehicle you will need to apply for a title. If you purchase a vehicle or take a trade in you will apply for a title for resale in your dealership name. If you sell a vehicle you will be required to apply for a title in your customer’s name with the new title being mailed directly to your customer. R.C. 1337.06

Your customer will need to give you permission to apply for the title by signing a notarized Power of Attorney or signing a notarized Dealer
Assignment form BMV 3772 that includes Power of Attorney.

Power of Attorney is a written document that is used when one person assigns another person the ability to act on their behalf. When you are applying for title for a vehicle you have sold your customer must sign a notarized Power of Attorney or Dealer Assignment granting your permission to act for them when ordering a new title.

In order to apply for a new title you will need to complete a title application on the back of the old title, or complete a notarized Dealer Assignment form BMV 3772, which is basically a dealer title application. If you are applying for a title simply by using the title application on the back of the title you will always need a separate notarized Power of Attorney. When transferring an out of state title to an Ohio title be prepared to use the
Dealer Assignment form as many states do not have a title application on the back of their titles. You will need an Out of State Inspection on out of state titles as well. Out of State Inspections will be covered later in the manual.

You will complete a notarized Power of Attorney on every transaction whether it is a separate Power of Attorney form or the Power of Attorney is
included on the Dealer Assignment form BMV 3772.

When completing a power of attorney be sure the customer enters their name and contact information along with the make, model, & VIN of the vehicle. The customer must then sign the power of attorney and include
their social security number.

IF THE TITLE YOU ARE USING HAS A TITLE APPLICATION ON THE
BACK AND YOU ARE USING IT TO APPLY FOR A NEW TITLE YOU
MUST ALSO USE A SEPARATE NOTARIZED POWER OF ATTORNEY.

It is recommended that you use the Dealer Assignment form BMV 3772 on every transaction. Some Clerk of Courts may ask you to use a Dealer Assignment form BMV 3772 AND a separate Power of Attorney on every transaction. Be sure to contact the Clerk of Courts your county lies in to
ensure what documents they require on motor vehicle transactions.

THE DEALER MAY NEVER USE A POWER OF ATTORNEY TO SIGN
FOR A CUSTOMER ON AN ODOMETER DISCLOSURE STATEMENT.

Any licensed motor vehicle dealers or agents who make false statements on the power of attorney may be found guilty of falsification, or falsification
in a theft offense. This is could happen to a dealer when your agent is using a Power of Attorney to apply for a title.

A SIGNED AND NOTARIZED POWER OF ATTORNEY AND/OR
DEALER ASSIGNMENT FORM BMV 3772 WILL BE REQUIRED ON
EVERY TRANSACTION.
