Ohio Salesperson License-NO LONGER REQUIRED!
I am going to show you how to Register your new business with the Ohio Secretary of State, how to easily obtain a Federal Employment ID Number, and how to easily obtain your Ohio Vendors License.
First, I want to cover Salesperson Licensing. Ohio dealers salespersons are no longer required to hold a salesperson license. However, any person that is compensated for selling a vehicle for an Ohio sales person must be employed by the dealer. This law changed when the Ohio Governor signed House Bill 238.
How to Submit a Salesperson Application
When you hire a salesperson, you can submit the salesperson application right through your dealer portal. If you have multiple locations, your salesperson can work at multiple locations. However, a salesperson is not allowed to work for another licensed dealer. A salesperson can only work for one licensed dealer and cannot work for more than one dealer at a time. Be sure you are submitting the correct details.
Notifying the BMV of a Salesperson Termination
As I mentioned earlier, you must notify the BMV within 48 hours if you terminate a salesperson. Even if it is an amicable split, the notification MUST be made. You can easily submit this notification through your dealer portal by clicking on Salesperson Services and then deleting their name.
If you prefer, you can also do this by mail by submitting BMV Form 4336, the Salespersons Termination Notice, which you can find here.
Maintaining a List of Salespersons
You must maintain a list of salespersons who are working at your dealership, as required by state law. While you do not have to display the list like you do your dealer’s license, you must be able to produce the list upon request by any BMV investigator, law enforcement personnel, or even a customer.
Storage of Salesperson Licenses
Finally, when your salesperson receives their license, they no longer need to carry it around as was required in the past. They can now store their salesperson license in your dealership's records.
